These Terms of Service ("Terms") govern your use of the GoSafety mobile application, web console, and related services (the "Service") operated by GoSafety AI, Inc. ("GoSafety," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
To use the Service, your organization must create an account. You are responsible for:
Organization administrators are responsible for managing user access and roles within their organization.
You agree to use the Service only for lawful purposes related to construction field operations, safety compliance, and workforce management. You may not:
You retain all ownership rights to the data you submit through the Service ("Your Data"), including daily reports, safety checklists, time entries, photos, and other content. You grant GoSafety a limited license to store, process, and display Your Data solely for the purpose of providing the Service to you.
You are responsible for the accuracy and legality of Your Data. GoSafety does not review or validate the content of field reports or safety checklists for compliance with any regulations.
You may export Your Data at any time through the Service's built-in export features (PDF, CSV). Upon account termination, you will have 30 days to export Your Data before it is deleted.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. The mobile application is designed to function offline, and data created offline will sync when connectivity is restored.
The Service, including its software, design, logos, and documentation, is owned by GoSafety and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
Access to the Service requires a paid subscription. Subscription terms, pricing, and billing details will be provided at the time of purchase. Subscriptions renew automatically unless canceled before the renewal date. Refunds are handled in accordance with our refund policy provided at the time of purchase.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GOSAFETY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
GoSafety does not warrant that the Service will meet your specific requirements, that it will be error-free, or that any defects will be corrected. The Service is a data collection and reporting tool — it does not replace professional safety judgment, regulatory expertise, or legal advice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOSAFETY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO GOSAFETY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless GoSafety and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Either party may terminate these Terms at any time. You may cancel your subscription and stop using the Service. We may suspend or terminate your access if you violate these Terms or if continued access poses a risk to the Service or other users.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and limitation of liability) will survive.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, by email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
